Child Custody

There are various types of child custody, but two most basic types that all other variations are based on, are legal and physical custody.

Legal Custody
Legal custody involves the obligation and responsibility to make decisions about the child’s upbringing, such as healthcare, schooling, religion and other important choices.

Physical Custody
Physical custody refers to where the child will live and who will provide for the child’s daily needs, such as food, shelter, grooming and so on.

Joint Custody
Both legal and physical custody can be shared, which is referred to as joint custody. A couple can share legal custody, but not physical custody, or a couple can share physical custody, but not legal custody. The court often considers joint custody, which allows the child to spend considerable time with both parents, to be in the child’s best interests.

Sole Custody
Parents can have sole custody of a child either physically or legally. When one parent has sole physical custody, this parent is referred to as the custodial parent. The non-custodial parent will have rights to visitation, also called parenting time.
